This matter is taken up through hybrid mode.

Heard Mr. P.S. Acharya learned counsel appearing on behalf of Opposite party Paradeep Port Trust. 3.

He places reliance on the communication of the Paradeep Port Trust Finance and Accounts Department dated 24/25 June 2020 indicting that an amount of Rs.23,11,679 (Rupees Twentythree Lakhs Eleven Thousands Six Hundred Seventy-Nine) including income tax which has been released in favour of the petitioner, in terms of the order of this Court dated 22.03.2001 for violation of which the present OCRMC has been filed. 4.

Such communication along with the letter dated 18.12.2019 of the Ministry of Shipping address to the Chairman PPT is kept on record.

Accordingly, the OCRMC is dropped.

6.

Since there is no appearance on behalf of the petitioner when the matter is called, it shall be open for the petitioner to approach this Court in case there is any subsisting cause of action. (V. NARASINGH) Judge Santoshi
