Heard Mr. M.K. Mohanty, learned counsel for the petitioner and Mr. Zafarulla, learned Additional Standing Counsel.

According to Mr. Mohanty, there exists an agreement between the petitioner and Sk. Mofijur Rehaman (opposite party No.4) dated 10.01.2019 under Annexure-1 by which he has been permitted to use the premises of opposite party No.4 till 2025 on payment of certain amount as advance. According to Mr. Mohanty, in tune with the said agreement, the advance money has already been paid. But notwithstanding such payment, the opposite party No.4 is attempting to remove the petitioner from the aforesaid premises by taking help of the I.I.C., Soro Police Station (opposite party No.3). Being aggrieved by such interference of opposite party No.3, the petitioner has filed a grievance petition before the Superintendent of Police, Balasore (opposite party No.2) on 26.04.2022 under Annexure-3 which was sent to the said opposite party through registered

// 2 // post on the same day however, till date no decision has been taken on the same. In such background, he prays that a direction be issued to the opposite party No.2 to take a decision on the grievance petition of the petitioner within a specific time period.

Considering the submissions made and without expressing any opinion on the merits of the case, this Court directs the Superintendent of Police, Balasore (opposite party No.2) to take a decision on the above noted grievance petition of the petitioner under Annexure-3 in accordance with law within a period of three weeks from the date of receipt of a certified copy of this order after giving reasonable opportunity of hearing to the petitioner as well as opposite party Nos.3 & 4 and communicate the result of such exercise to the petitioner. 4.

Accordingly, this CRLMP is disposed of.
