Heard learned counsel for the petitioner and learned Additional Standing Counsel for the State.

The petitioner is in custody since 08.03.2022 in connection with Dharamgarh P.S. Case No. 57 of 2022 corresponding to C.T. Case No. 143 of 2022 pending in the court of learned S.D.J.M., Dharamgarh for the alleged commission of offence under Sections 498-A/302 of IPC.

The petitioner is the husband of the deceased, who is said to have committed suicide. From the materials on record, it appears that the deceased suspected the petitioner of having an illicit relationship with her sister, who was staying with them for some time. There is no other allegation of any cruelty being meted out by the petitioner to the deceased.

Considering the submissions, the materials on record and the period of detention in custody, I am inclined to allow the prayer for bail. Let the petitioner be released on bail on such terms and conditions as the court in seisin over the matter may deem fit and proper to impose including the condition that the petitioner shall personally appear before the trial court on each date of posting of the case without fail.

The BLAPL is accordingly disposed of.

Urgent certified copy of this order be granted on proper application.
