This matter is taken up through Hybrid Mode.

Heard learned counsel for the parties.

The petitioners are seeking pre-arrest bail in connection with Bhuban P.S. Case No. 12 of 2022 corresponding to G.R. Case No. 11 of 2022, pending on the file of the learned JMFC, Bhuban for commission of offence under Section 394 of the I.P.C.

It is submitted by the learned counsel for the petitioners that since similarly circumstanced co-accused has been released on anticipatory bail by this Court vide order dated 1.02.2022 in ABLAPL No. 398 of 2022, the petitioners are entitled to be released on bail. 5.
Learned counsel for the State opposes the prayer for anticipatory bail.

Taking into account the nature of the allegations and release of the co-accused, this Court directs that on surrendering within three weeks hence and moving for bail, petitioners shall be released on bail by the learned court in seisin over the matter on such terms and conditions as deemed just and proper.

Accordingly, the ABLAPL stands disposed of.

Urgent certified copy of this order be granted as per rules.
