Considering the Writ Petition involves a 15(b) of the O.S.S. Act order and the Parties have the scope to get appropriate declaration from Civil Court, further looking to the limited nature of consideration involving the Application under Section 15(b) of the O.S.S. Act, this Court is not inclined to interfere with the impugned order. The Writ Petition though stands disposed of, Parties may be at liberty, if necessary and advised, to take up the issue through appropriate forums. Interim order dated 23.7.2009 passed in Misc. Case No.7975/2009 stands vacated.
