This matter is taken up through Hybrid Mode.

Order No 2.

Heard learned counsel for both the Parties.

The present Writ Petition has been filed with the following prayer:- "1. To issue Rule NISI in the nature of Writ of Mandamus by asking the Opp.Parties to submit show cause as to why the claim of the petitioner in respect of his Employee Provident Fund Scheme vide VDR No.UPLKO00432550000000647 for the period from 16.01.2012 till 07.01.2016 shall be released in his new EPF account allotted or else it can be refund the entire amount of EPF in his favour and if the Opp.Parties fails to file show cuase or show insufficient cause then the above Rule may kindly be made absolute".

Taking into account the nature of claim made in the Writ Petition and the prayer made by the learned counsel for the Petitioner, the Petitioner is permitted to make a fresh representation before Opp. Party No.3 within a period of 7(seven) days from today.

It is observed that if such a representation is filed by the Petitioner ventilating his grievances, the same shall be

// 2 // considered by Opp. party No. 3 in accordance with law and the benefit as claimed if the petitioner is found eligible within a period of 15(fifteen) days. The order so passed by Opp. Party No.3 be communicated to the Petitioner within that time 6.

With the aforesaid observation and direction, the Writ Petition is disposed of.
