For the decision of the Hon'ble apex Court in Rahul S. Shah vrs. Jitendra Kumar Gandhi & ors : (2021) 6 SCC 418, the interim order dated 9.9.2004 staying further proceeding of the suit stood vacated. Learned counsel for the Petitioner also submits that he has no instruction as to whether the suit involved herein still surviving. 3.
