This matter is taken up through Hybrid Arrangement (Virtual /Physical Mode).

Heard learned counsel for the Petitioner and learned Additional Standing Counsel.

The Petitioner has filed this writ petition with the following prayer :

" It is therefore prayed that this Hon'ble Court may graciously be pleased to admit this writ application and an order may be passed directing the Opposite Parties to sanction/disburse the Grade Pay of Rs.5400/- towards 3rd upgradation under RACP Scheme with effect from 01.01.2013 in favour of the Petitioner, who retired from service on 28.02.2018 as an Assistant Agriculture Officer, after his superannuation as some other Retired A.A.Os being on the same footing have already obtained the said Grade Pay.

In course of hearing, learned counsel for the Petitioner submits that the Petitioner seeks liberty to file a fresh representation ventilating his grievance before the Secretary to Government, Agriculture & Farmers' Empowerment Department, Opposite Party No.1 which may be considered within a stipulated period of time in

Learned counsel for the State on the other hand submits that he has no objection if liberty is granted to the Petitioner to file a fresh representation before the Opposite Party No.1 and the same is considered and disposed of in accordance with law. 5.

In view of the aforesaid limited nature of grievance of the Petitioner, this Court disposes of the writ petition granting liberty to the Petitioner to file a fresh representation before the Opposite Party No.1 ventilating his grievance within a period of two weeks. If such a representation is filed within the time stipulated, the same shall be considered and disposed of by the opposite party no.1 in accordance with law within a period of two months thereafter and the decision so taken on the representation of the Petitioner shall be communicated within two weeks thereafter.

With the aforesaid observation the writ application stands disposed of.

Issue urgent certified copy as per Rules.
