This matter is taken up through Hybrid Mode.

Order No 2.

Heard learned counsel for both the Parties.

The present Writ Petition has been filed with the following prayer:- "1. Directing the opp.parties to sanction / disburse the Grade Pay of Rs.5400/- towards 3rd up gradation under RACP Scheme w.e.f. dtd. 01.01.2013 in favour of the petitioner who retired from service on 30.09.2016 as an Asst. Agriculture Officer, after his superannuation as some other Retied A.A.Os being on the same footing have already obtained the said Grade Pay".

Taking into account the nature of claim made in the Writ Petition and the prayer made by the learned counsel for the Petitioner, the Petitioner is permitted to make a fresh representation before Opp. Party No.2 within a period of three weeks from today.

It is observed that if such a representation is filed by the Petitioner ventilating his grievances, the same shall be considered by Opp. party No. 2 in accordance with law within a

// 2 // period of the two months from the date of filing of such representation. The order so passed by Opp. Party No.2 be communicated to the Petitioner within that time. 6.

With the aforesaid observation and direction, the Writ Petition is disposed of.
