This matter is taken up through hybrid mode.

The Petitioner in this writ petition seeks to assail the notice issued in his name to appear in Demarcation Case Nos. 45 and 46 of 2022 before the Tahasildar, Ersama-Opposite Party No.4 and to participate in the demarcation of the land in Plot Nos.1268/1484 to an extent of Ac.3.25 decimals, 166 to an extent of Ac.28.15 decimals and 166/2016 to an extent of Ac.1.50 decimals under Khata No.327 situated in Mouza Kunjakothi under Ersama Tahasil in the district of Jagatsinghpur.

In course of hearing, Mr. Swain, learned counsel for the Petitioner fairly concedes that the Petitioner has not yet appeared and filed his objection in the said demarcation cases and the demarcation of the land has not yet been done. 4.

Taking into consideration the submission made by Mr. Swain, learned counsel for the Petitioner that the demarcation of the land has not yet been made, this Court disposes of the writ petition with an observation that in the event, the Petitioner appears and file his objection to the demarcation cases, the same

// 2 // shall be considered in accordance with law giving opportunity of hearing to the parties concerned before proceeding for demarcation of the land in question, if not already made in the meantime.

Urgent certified copy of this order be granted on proper application.
