Heard learned counsel for the parties.

Petitioners have a statutory remedy of Appeal. It is better, Petitioners get the exercise of Appeal under Section 18 of the Odisha Development Authority Act, 1982. Petitioners attempted to entertain the writ application here on the premises of certain grounds taken therein, even grounds including in similar situation over the plot owners have been provided with opportunity whereas Petitioners are prevented from the similar remedy. Grounds, if any, raised herein can be agitated in the memorandum of Appeal and adjudicated by the Appellate Authority. In the circumstance, this Court permits the withdrawal of the writ petition with liberty to the Petitioners to file Appeal at least within a period of two weeks. In such event, the Appeal shall be considered giving opportunity of hearing to all concerned. (Biswanath Rath) Judge Swarna
