Heard learned counsel for the parties.

The petitioner is an accused in connection with C.T. Case No. 22 of 2022 arising out of Phiringia P.S. Case No. 55 of 2022, pending on the file of the learned Sessions Judge-cum-Special Judge, Phulbani for the alleged commission of offence under Sections 20(b)(ii)(C)/25/29 of the NDPS Act.

Being aggrieved by the rejection of his application for bail under Sec. 439 Cr.P.C. by the learned Special Judge, Phulbani by order dated 29.04.2022, the present BLAPL has been filed. 5.

The consideration by the learned Court in seisin over the matter was during the course of investigation. 6.

The petitioner is at liberty to move the learned Court below after filing of Charge-Sheet. The same shall be considered

on its own merit without being influenced by the earlier rejection order or the order passed by this Court.

The Bail Application thus, stands disposed of. 8.

Urgent certified copy of this order be granted as per rules.
