The petitioner in this application under Section 482 of the Code of Criminal Procedure (for short "Cr.P.C.") challenges the order dated 18.08.2011 passed by the learned S.D.J.M., Balasore in I.C.C. No.463 of 2011 taking cognizance of offence under Section 138 of the N.I. Act. 3.
Heard the learned counsel for the petitioner. None appears for the opposite party.

The present status of the aforesaid complaint case is not known to the learned counsel for the petitioner. Hence, this Court is not inclined to interfere with the impugned order.

Hence, this CRLMC filed challenging the impugned order stands dismissed with liberty to the petitioner to file a fresh petition, if any cause of action survives, notwithstanding the dismissal of this petition.
