1. This matter is taken up through hybrid mode. Order No.
2. Heard learned counsel for the Petitioner and learned Addl. Standing Counsel for the State.
3. The Petitioner is in custody since 6th April, 2022 in connection with Singhadwar P.S.
Case No.23/2022 corresponding to G.R. Case No.745/2022 pending in the court of learned S.D.J.M., Puri for the alleged commission of the offence under Sections 427/295/295-A/34 of I.P.C. read with Section 30 (A)(H)(b) of Shri Jagannath Temple Act.

5. It is alleged that the Petitioner forcibly entered into the Rosasala of Lord Jagannath Temple and damaged several earthen hearths therein. It is submitted that the Petitioner is mentally unstable and, therefore, he was not aware of the consequence of his act. That apart, he has been in custody for nearly five months by now. Charge sheet has already been submitted.
6. Taking into consideration all the above facts and the fact that charge sheet has already been submitted, I am inclined to allow the prayer for bail. Let the Petitioner be released on bail on such terms and conditions as may be imposed by the court in seisin over the matter in the aforesaid case including the condition that he shall appear before the court below on each date of posting of the case without fail.
7. The BLAPL is disposed of.
8. Urgent certified copy of this order be granted on proper application.
