1. The challenge in the present petition by the Petitioner is to an Order No.

order of the Orissa Information Commission (OIC) imposing a penalty of Rs.18,000/- on him. That order was stayed by this Court on 16th July, 2009. The Petitioner was already 60 years old then and now is well above 70.

2. Considering the facts and circumstances of the case, the impugned order of the OIC dated 13th March, 2009 in Second Appeal No.69 of 2007 to the extent of the above fine on the Petitioner is set aside.
