This matter is taken up through hybrid mode.

The Petitioner in this writ petition prays for a direction for early disposal of Confiscation Proceeding Case No.09 of 2020-21 pending before the Authorized Officer-cum-Assistant Conservator of Forests (T), Athamallik Forest Division. 3.

Considering the submission of learned counsel for the Petitioner, this Court vide order dated 20th June, 2022 directed learned State Counsel to take instruction in the matter. 4.

Mr. Mishra, learned Additional Government Advocate, on instruction, submits that five witnesses have already been examined in the confiscation proceeding and nine other witnesses are required to be examined. The matter is next posted to 30th June, 2022 for examination of the witnesses. 5.

Mr. Bose, learned counsel for the Petitioner submits that due to pendency of the confiscation proceeding, the vehicle of the Petitioner bearing Registration No.OD-19-0718 (Tractor) is being damaged as it is kept under the open sky. In that view of

// 2 // the matter, he prays for early disposal of the confiscation proceeding.

In view of such submission, this Court without expressing any opinion on the merits of the case disposes of this writ petition with a direction to the Authorized Officer-cumAssistant Conservator of Forests, Athamallik Forest DivisionOpposite Party No. 2 to dispose of Confiscation Proceeding No.09 of 2020-21 so far as the Petitioner's vehicle is concerned as expeditiously as possible preferably within a period of four months from the date of production of certified copy of this order.

Urgent certified copy of this order be granted on proper application.
