Heard learned counsel appearing for the petitioner. Order No.

Considering the submission of learned counsel for the petitioner, this Court finds application for modification in the status quo order to the extent thatching the house structure already existing on the suit land has been rejected on the technical ground for petitioner has neither filed any sketch map nor has any specification on the existing house. 3.

Considering this to be a technical rejection of the application of the petitioner, this Court declining to interfere in such order however observes in the event petitioner brings a proper application with all details, there shall be fresh consideration of such application by the trial court but however after involving the parties likely to be suffering on account of such application.

The Civil Miscellaneous Petition stands disposed of with the observation made hereinabove.
