1. This matter is taken up through hybrid mode. Order No.

2. Heard learned counsel for the Petitioner and learned Addl. Standing Counsel for the State.

3. As per the surrender certificate available in the case record, the Petitioner is surrender to custody on 16th August, 2022 after expiry of the period of interim bail.

4. The Petitioner is in custody since 8th April, 2022 in connection with Rasol P.S. Case No.80/2022 corresponding to G.R. Case No.204/2022 pending in the court of learned

// 2 // S.D.J.M., Hindol for the alleged commission of the offence under Sections 395/506/397 of I.P.C. read with Section 3 PDPP Act and section 25 of the Arms Act.

5. It is alleged that the Petitioner and some other persons were involved in stealing electricity wires from the newly erected 33 KV-11 KV feeder lines by using gas cutter. It is submitted that the Petitioner was implicated on the basis of the statement of the co-accused and there is no other impendent material to show his complicity in the occurrence.

6. Taking into consideration all the above facts and the fact that charge sheet has already been submitted, I am inclined to allow the prayer for bail. Let the Petitioner be released on bail on such terms and conditions as may be imposed by the court in seisin over the matter in the aforesaid case including the condition that he shall appear before the court below on each date of posting of the case without fail.

7. The BLAPL is disposed of.

8. Urgent certified copy of this order be granted on proper application.
