Heard Mr.J.Behera, learned counsel for the petitioners and Mr.D.K.Mohanty, learned Addl. Standing Counsel. 2.

During course of hearing Mr.Behera, learned counsel for the petitioners submits that the present writ petition be confined to petitioner Nos. 2 to 5 only and so far as petitioner No.1 is concerned he is withdrawing the writ petition with liberty to file a better petition. To that effect he files a memo in Court today. The same be tagged to the records.

Prayer is allowed.

According to Mr.Behera the petitioner Nos. 2 to 5 are aggrieved by inaction of the authorities in paying them compensation though their lands have been acquired for the purpose of Lower Suktel Irrigation Project in the district of Bolangir.

During course of hearing, learned counsel for the petitioners submits liberty may be granted to petitioner Nos. 2 to 5 to file individual representations before the

// 2 // Special Land Acquisition Officer, Lower Suktel Irrigation Project, Bolangir (opposite party No.3) and further prays that a direction may be issued to the said opposite party to take a decision of their representations within a specific time period.

Considering such submissions and without expressing any opinion on the merits of the case, this Court grants liberty to petitioner Nos. 2 to 5 to file individual representations before opposite party No.3 along with a copy of this order by registered post with A.D. within a period of two weeks hence.

In the event, such representations are received by the opposite party No.3, he/she is directed to take a decision on the same in accordance with law within a period of four months there from and communicate the result of such exercise to petitioner Nos. 2 to 5.

The writ petition is accordingly disposed of. 8.

Urgent certified copy of the order be granted on proper application.
