1. This matter is taken up through hybrid mode. Order No.

2. Heard learned counsel for the Petitioner and learned Addl. Standing Counsel for the State.

3. The Petitioner is in custody since 17th March, 2022 in connection with Angul P.S. Case No.151/2022 corresponding to G.R. Case No.290/2022 pending in the court of learned J.M.F.C., Banarpal for the alleged commission of the offence under Sections 417/376(1)/294/506/34 of I.P.C..

4. It is alleged that the Petitioner forcibly committed sexual intercourse with the victim and also threatened to make her nude photographs viral on social media. The F.I.R. as well as the statement recorded under Section 161 of Cr.P.C. of the victim indicates that the relation between them was consensual in nature and the case appears to have been registered only because the Petitioner refused to marry her.

5. Considering the submissions made, the materials on record and the period of detention of the Petitioner in custody, I am inclined to allow the prayer for bail. Let the Petitioner be released on bail on such terms and conditions as may be imposed by the court in seisin over the matter in the aforesaid case including the condition that he shall appear before the court below on each date of posting of the case without fail.
