1. The matter is taken up through Hybrid mode.

2. Heard Mr.Sahoo, learned counsel for the Petitioner and Mrs.Pattnaik, learned counsel for the State.

3. This is an application under Section 439 Cr.P.C. for grant of bail to the Petitioner in connection with C.T.Case No.554 of 2021 arising out of Bargarh Sadar P.S.Case No.139 of 2021 committed to C.T.Case No.85 of 2021 pending in the court of the learned District and Sessions Judge, Bargarh for alleged commission of offence under Sections 302/34 of the I.P.C.

It is submitted on behalf of the Petitioner that three coaccused persons including Satya Budek have been released on bail by this Court in different bail applications and copies of the same have been appended under Annexure-2 series. It is further submitted that the Petitioner is inside custody since 7.6.2021 and he is standing on same footing with that Satya Budek, who has been released on bail in BLAPL No.8588 of 2021.

5. After hearing Mrs.Pattnaik, learned counsel for the State and considering the fact of release of other co-accused persons and the footing of the present prtitioner with Satya Budek, who was taken to custody on 12.7.2021 and has been granted bail, it is directed that the Petitioner be released on bail in the aforesaid case on such terms and conditions to be fixed by the learned court below in seisin over the matter including the condition that he shall not dissuade any witness directly or indirectly by way of inducement, threat or promise acquainted with the facts of the case from disclosing such facts before the court or tamper with the evidence.

6. The BLAPL is disposed of.

7. Urgent certified copy of this order be granted on proper application.
