Heard learned counsel for the Parties.

For the submission of Mr.D.Mohapatra, learned counsel for the Development, there is no availability of 'F' Category residential plot to be allotted through lottery. Mr.Mohapatra, further fairly brings to the notice of this Court the order of a Division Bench of this Court dated 3.12.2009 passed in W.P.(C) No.645 of 2009, wherein this Court in disposal of similar Writ Petition kept the scope for consideration of the claim of the Petitioner in future allotment of 'F' Category plot through lottery scheme.

This Court in disposal of the Writ Petition in the light of the direction issued in W.P.(C) No.645 of 2009 disposed of on 3.12.2009 observes, in the event the Cuttack Development Authority

// 2 // comes up with 'F' Category plot to be distributed through lottery system and if the Petitioner applies to the same, her case will be duly considered in accordance with law.
