1. This matter is taken up through Hybrid mode. Order No.

The grievance of the Petitioner is that though he has approved plan for construction of four storied building located at Mouza-Chandrasekharpur but the Opposite Parties-TPCODL through contractor has constructed four pillars at the entrance of the under construction apartment as such he is unable to carry out the construction. In this regard, he has made a representation to the Divisional Manager (Electrical), BCDDII, Nayapalli, TPCODL, Opposite Party No.4, for realignment of the said line, vide Annexure-4, but no action on the same

// 2 // having been taken, he has come to this Court seeks a direction to the Opposite Party No.4 to remove the said structure.

However, during the course of hearing, it is submitted by Mr. Mohanty, learned counsel for the Petitioner, that it would be suffice instead of issuing notice to the Opposite Parties, this Court directs the Opposite Party No.4 to consider his representation within a stipulated period taking note of the alternative site available for removal of the said structure for which he is ready and willing to pay the cost.

Considering such submission of the learned counsel for the Petitioner, this Court disposes of the writ petition with a direction to the Divisional Manager (Electrical), Nayapali, BCDD-II, TPCODL, Opposite Party No.4, to consider the representation of the Petitioner by taking informed and considered decision on the same, vide Annexure-4, not later than three weeks from the date of receipt of a certified copy of this order by exploring an alternative site and intimate the decision thereof to the Petitioner immediately.

5. Urgent certified copy of this order be granted on proper application.
