Heard Mr. D. Sethy, learned counsel for the petitioner and Mr. D. Nayak, learned Additional Government Advocate. 2.

According to Mr. Sethy, the petitioner is aggrieved by the payment of compensation in respect of his land i.e. Plot No.1657 pertaining to Sabik Khatya No.448/576 under mouza Dwarika of Nilagiri Tahasil in the district of Balasore to opposite party Nos.4 to 12 under a misconception of fact as the land never belonged to them.

Mr. Nayak submits that if there is any dispute with regard to whom the compensation is to be paid, then the petitioner is required to approach the appropriate authority as provided under Sections 64 and 76 of the Right to Fair Compensation and Transparency in Land Acquisition, Rehabilitation and Resettlement Act, 2013. In such background, he submits that instead of approaching the appropriate authority, the petitioner has unnecessarily rushed to this Court.

In such background, Mr. Sethy wants to withdraw this

// 2 // writ petition as he wants to approach the appropriate authority for redressal of the grievances of the petitioner. 5.

Considering the submissions made, this writ petition is disposed of as withdrawn.
