2. This application under Section 482 Cr.P.C. has been filed by the Petitioner for quashment of the entire proceeding initiated by the Vigilance Department in shape of Vigilance P.S. Case No.33 of 2009 corresponding to T.R. No.4 of 2011 filed in the court of Special Judge, Vigilance, Balasore.

Learned counsel for the Petitioner submits that he has no instruction in this matter.

In such view of the matter, this Court is of the view that the Petitioner is a recalcitrant litigant and does not want to proceed with the matter.

Accordingly, this CRLMC stands dismissed for nonprosecution.

However, liberty is given to the Petitioner to challenge the proceeding, if the cause of action still survives. 7.
