Heard Mr. N. Lenka, learned counsel for the petitioner and Mr. Ch.S. Mishra, learned Additional Government Advocate. 2.

According to Mr. Lenka, the father of the petitioner lost land for opening up of Kaniha Open Cast Project of Mahanadi Coalfield Limited and according to him as the son of the land loser and land oustee, the petitioner is eligible and entitled for employment benefits under the Odisha Rehabilitation and Resettlement Policy, 2006. Though highlighting his grievances, the petitioner has filed a representation before the General Manager, Kaniha area, Mahanadi Coalfield Limited (opposite party No.7) vide Annexure-7 and though the same was received in the Office of the said opposite party on 04.10.2021 but till date, nothing has been done in the matter. In such background, he prays that that a direction be issued to opposite party No.7 to take a decision on the above noted representation within a specific time period.

Considering the submissions made and without

// 2 // expressing any opinion on the merits of the case, this Court directs the opposite party No.7 to take a decision in accordance with law as to whether the petitioner is entitled to the employment under the relevant policy within a period of eight weeks from the date of receipt of a certified copy of this order and communicate the result of such exercise to the petitioner. It is made clear that if the opposite party No.7 finds the petitioner to be eligible for such employment, then he be extended the same benefit.

Accordingly, this writ petition is disposed of. 5.

Urgent certified copy of this order be granted on proper application in course of the day.
