Heard Mr. R.L. Pattnaik, learned counsel for the Petitioner and Mr. A. Rath, learned Additional Standing Counsel. 2.
This is an application under Section 439 Cr.P.C. for grant of bail to the Petitioner Umasankar Pande in connection with Orkel P.S. Case No.191 of 2019 corresponding to T.R. Case No.131 of 2019 pending in the court of learned Sessions Judge-cum-Special Judge, Malkangiri for alleged commission of offence under Section 20(b)(ii)(c) of the NDPS Act for possession of contraband ganja weighing about 75 kg. 750 grams.

Keeping in view the embargo contained in Section 37(1)(b) of the NDPS Act I am not inclined to release the Petitioner on bail. Accordingly his prayer for bail is rejected.

However as prayed on behalf of the Petitioner, he is at liberty to renew his prayer for bail after examination of relevant witnesses. 5.
The BLAPL is accordingly disposed of.
