Heard the submission of learned counsel for the parties. 2.
For the availability of statutory remedy of appeal and the statutory authority for having scope of adjudicating the grounds agitated here, this Court finds the writ petition is not entertainable at this stage of the matter. Considering the submission of Mr.Mishra, learned counsel for the petitioner, this Court permits the petitioners to withdraw the writ petition with liberty to the petitioner to file appeal. In the event the appeal is filed within a period of two week hence with certified copy of this order, the Appellate Authority shall entertain the appeal and decide the same on its own merit but however involving the parties likely to be affected.
