Heard learned counsel for the petitioner and learned counsel for the State.

The petitioner is seeking pre-arrest bail in connection with G.R. Case No. 280 of 2022, arising out of Jeypore Town P.S. Case No. 66 of 2022 pending in the Court of learned S.D.J.M., Jeypore for the alleged commission of offence punishable under Sections 147/148/323/326/341/307/149 of the I.P.C.

It is submitted that the learned counsel for petitioner that this Court vide order dated 20.05.2022 passed in ABLAPL No. 4583 of 2022, has directed for release of one Bikash Suna, petitioner No.2 therein. It is stated that the petitioner is similarly circumstanced, inasmuch as the specific overt act is attributed to one Tushar Garada.

Taking note of such submissions and in view of the order passed by this Court as noted above, this Court directs that on surrendering within three weeks hence and moving for bail, the petitioner shall be released on bail. The Learned Court in seisin over the matter to fix the terms and conditions as deemed just and proper.

Accordingly, the ABLAPL stands disposed of.
