1.The challenge in the present appeal is to an order dated 14th August, 2013 of the learned Single Judge dismissing Writ Petition (Civil) No.20395 of 2010 filed by the present Appellant.
2. The Appellant had questioned the appointment given to Respondent No.4 when she did not belong to the Pandua village for which the advertisement had been issued for appointment of an Anganwadi Worker.
3. The Additional District Magistrate, Cuttack (ADM) ordered an inquiry and found that Pandua was a hamlet of village of Alarpur and the AWC, Pandua which was catering to the inhabitants of Pandua, Charigharia and Alarpur. With Respondent No.4 being a resident of Alarpur and having secured the highest marks, her appointment was upheld.
4. The impugned order of the learned Single Judge has proceeded on the basis of the factual findings in the report submitted by the ADM and that factual finding which were unable to be overcome by the counsel for the Appellant either before the learned Single Judge or before this Court. Consequently, this Court is not inclined to interfere with the impugned order of the learned Single Judge.
5. The appeal is dismissed.
