This matter is taken up through hybrid arrangement (virtual/physical mode.) 2.

Heard learned counsel for the Petitioner and learned counsel for the State.

It is submitted on behalf of the Petitioner that the Petitioner is an accused in C.T. (Special) Case No.25 of 2015, in connection with Sadar P.S. Case No.377 of 2013, pending in the court of Judge, Special Court, Dhenkanal, for commission of alleged offences under Sections 341/323/ 294/506/34 of I.P.C. and Section 3(i)(x) of S.C./S.T. (P.A.) Act. It is submitted that accused is on court bail and had been attending the court regularly and only on 04.08.2016 since he remained absent and step was not taken on his behalf by the concerned Advocate, N.B.W. of arrest was issued against the Petitioner. The said order is under challenged before this Court.

It is also submitted that due to communication gap, the Petitioner could not attend the court.

Considering the submission, it is directed that the order dated 04.08.2016, passed by the Judge, Special Court, Dhenkanal for issuance of N.B.W. of arrest against the Petitioner is set aside subject to cash security of Rs.5,000/- (Rupees Five thousand) and Petitioner is given liberty to surrender before the aforesaid court in C.T. (Special) Case No.25 of 2015 within a period fortnight hence, which shall be dealt with in accordance with law.

The CRLMC is accordingly disposed of.

Issue urgent certified copy as per rules.
