CORAM:
JUSTICE S. TALAPATRA JUSTICE B.P. ROUTRAY
ORDER
21.06.2022 Order No.
01.
1.
This matter is taken up through Hybrid Arrangement (Virtual/ Physical Mode).
2.
Heard Mr. P.K. Mishra, learned counsel for the appellant. 3.
The appellant has challenged the order dated 07.04.2022 delivered in W.P.(C) No.7570 of 2022.
4.
The genesis of controversy in the writ petition can be located in seizure of the vehicle, which was hypothecated to the bank for nonpayment of the outstanding. In the impugned order, learned Single Judge directed the writ petitioner-respondent to deposit 50 percent of the entire outstanding due. On such deposit, the bank-appellant was directed to adopt a lenient view and they may take the decision as regards releasing the said vehicle.
5.
We do not find any material to interfere with such direction. The bank shall take their decision as expeditiously as possible, as it has been stated by the counsel for the writ petitioner-respondent that, they have deposited 50 percent of the entire outstanding. 6.
Accordingly, this appeal stands dismissed. However, in the context, there shall be no order as to cost.
(S. Talapatra) Judge (B.P. Routray) Judge Subhasis
