IN THE HIGH COURT OF ORISSA AT CUTTACK

CONTC No.769 of 2019 M/s. Saiyyad Sultan .... Petitioner Mr. Sukanta Kumar Dalai, Advocate -versusRajib Kumar, Managing Director, Odisha Forest Development Corporation Ltd., Bhubaneswar, District-Khurda .... Opp. Party/ Contemnor None

CORAM:

JUSTICE JASWANT SINGH JUSTICE M.S. RAMAN Order No.

ORDER (Oral) 12.07.2022 02.

1.

This matter is taken up through hybrid arrangement (virtual/physical mode).

2.

The present contempt has been filed with the allegation that the amounts required to be refunded in terms of the order dated 30th April, 2019 passed by this Court in W.P.(C) No.18777 of 2017 have actually not been remitted to the petitioner.

3.

At the time of hearing, learned counsel for the petitioner very fairly concedes that the aforesaid order dated 30th April, 2019 was set aside by the Hon'ble Supreme Court in a decision dated 28th November, 2019 passed in Civil Appeal No.9083 of

// 2 // 2019 and the connected appeals and hence, nothing survives in the present contempt.

4.

In view of the above, the CONTC is dismissed as infructuous.
