1. This matter is taken up through hybrid mode.
2. Heard learned counsel for the Petitioner and learned Addl. Standing Counsel for the State.
3. This is an application for modification of the order dated 30th September, 2022. It is submitted that because of financial stringency, the Petitioner is unable to arrange Rs.3 lakhs to be furnished as cash security as one of the condition for being
// 2 // released on bail. It is seen that the Petitioner was granted bail on 30th September, 2022, more than two months have elapsed in the meantime and he has not been released. This amounts to refusal of bail.
4. Therefore, taking a lenient view the condition imposed by order dated 30th September, 2022 to furnish cash security of Rs.3 lakhs is modified to the extent of Rs.1,00,000/- (Rupees one lakh). All other conditions shall remain intact.
5. The I.A. is, accordingly, disposed of.
6. Urgent certified copy of this order be granted on proper application.
