This matter is taken up through hybrid mode.

Heard learned counsel for the petitioner and learned counsel for the State.

The petitioner is seeking pre-arrest bail in connection with G.R. Case No.461 of 2022, arising out of Parjanga P.S. Case No.471 of 2022 pending in the Court of learned J.M.F.C., Parjanga for commission of offence punishable under Sections 272/273 of the IPC read with Section 52(a)(i) of Odisha Excise Act, 2008. 4.

Taking into account the nature of allegation, this Court directs that on surrendering within three weeks hence and moving for bail, the petitioner shall be released on bail. The Court in seisin to fix the terms.

It is stated by learned counsel for the petitioner that the petitioner has no criminal proclivity. While enlarging the petitioner on bail the learned Court below shall verify such assertion. If it

comes to the fore that the petitioner has any criminal antecedent, this order shall stands recalled automatically without any further reference to this Court.

Accordingly, the ABLAPL stands disposed of.
