IN THE HIGH COURT OF ORISSA AT CUTTACK

BLAPL No. 4143 of 2022 Kishore Jena ....

Petitioner Dr. B.K. Mishra, Advocate - Versus - State of Odisha .... Opposite Parties Mr. S.K. Mishra, Addl. Standing Counsel

CORAM:

JUSTICE SASHIKANTA MISHRA

ORDER

01.08.2022 1.

This matter is taken up through hybrid mode.

Order No.

02.

2.

Heard learned counsel for the petitioner and learned Addl. Standing Counsel for the State.

3.

The petitioner's application for bail was earlier rejected by this Court as per order passed in BLAPL No. 2256 of 2022. This is the successive bail application filed on purported change in circumstances that the co-accused has been granted bail. 4.

I do not find any change in circumstance warranting a different view being taken at this stage. Further, the co-accused who was released on bail being a lady with two small children stands on entirely a different footing. As such, I am not inclined to allow the prayer for bail, which is therefore, rejected. It is open to the petitioner, to renew his prayer for bail later. 5.

The bail application is rejected.
