3. This appeal has been filed challenging the order dated 30.11.2002 against the order passed by the learned 2nd MACT(SD), Berhampur in MJC No.2 of 2002 in an application filed under Order 9 Rule 13 C.P.C read with Rule-20 of Orissa Motor Vehicle (Accident Claims Tribunal), Rules.

4. Even though the appeal was filed in the year 2003 and this Court vide order dated 5.4.2003 issued notice on the respondents, but no requisites have been filed for issuance of notice till date.
