This matter is taken up through hybrid mode.

Heard learned counsel for the petitioner and learned counsel for the State.

The petitioner is accused in T.R. Case No.70 of 2021 arising out of Satyabadi P.S. Case No.364 of 2020, pending in the file of learned Special Judge, Puri, under Sections 21(c)/29 of the NDPS Act.

Being aggrieved by the Rejection of his application for bail U/s.439 Cr.P.C. by the learned Special Judge, Puri, by order dated 04.05.2022 in the aforementioned case, the present BLAPL has been filed.

Perused the order of rejection.

Learned counsel for the petitioner has placed on record the bail application filed by the petitioner-accused before the learned District & Sessions Judge, Puri.

In paragraph-4 thereof it has been specifically stated that the petitioner suffering from abdominal pain was admitted in S.C.B.

Medical College and Hospital in the department of Gynecology (Bed No.640).

It is submitted that though in the prayer it has not been indicated that the petitioner is seeking interim bail on the ground of her health condition and on account of illness of her daughter, but the tenor of the same seems to have escaped the careful consideration of the learned Court while considering the bail application.

Taking note of the submission of learned counsel for the petitioner and taking into account the nature of illness as stated, this Court directs the petitioner to be released on bail for a period of four months from the date of release. Learned Court in seisin over the matter to fix the terms.

It shall be open for the petitioner to renew her prayer before the learned Court below since it is stated at the bar that the petitioner had in fact sought intervention of the Court in seisin over the matter for release on interim bail.

Accordingly, the BLAPL stands disposed of.
