Heard learned counsel for the petitioner and learned Additional Standing Counsel for the State.

The petitioner is in custody since 28.11.2022 in connection with Baramba P.S. Case No. 266 of 2021 corresponding to G.R. Case No. 257 of 2021 pending in the court of learned J.M.F.C., Baramba for the alleged commission of offence under Sections 341/323/294/324/506/325/307/302/34 of IPC.

It is submitted that the petitioner is not main assailant and no overt act has been attributed to him, which resulted in death of the deceased. Standing on similar footing one Atal Bihari Rout@Atal Rout has been released on bail by this Court in BLAPL No. 5180 of 2022.

Considering the above fact, I am inclined to allow the prayer for bail. Let the petitioner be released on bail on such terms and

conditions as the court in seisin over the matter may deem fit and proper to impose including the condition that the petitioner shall personally appear before the trial court on each date of posting of the case without fail.

The BLAPL is accordingly disposed of.

Urgent certified copy of this order be granted on proper application.
