This matter is taken up through hybrid mode.

The Petitioner apprehending his arrest in Simulia P.S. Case No.170 of 2019 registered for alleged commission of offence punishable under Section 302 read with Section 34 of the I.P.C., has filed this petition for his release on pre-arrest bail.

Heard the learned counsel for the Petitioner and the learned counsel for the State.

It appears that the Petitioner had approached this Court earlier vide ABLAPL No.12212 of 2019 and this Court on 4th December, 2019 wherein he was directed to surrender before the court below, but instead of complying with the same, he has again approached this Court by filing the instant bail
// 2 // application on the ground that co-accused persons have already been released on bail.

But, I am not inclined to entertain his prayer under Section 438 of Cr.P.C. again on the ground stated to review the earlier order.

Accordingly, the prayer for pre-arrest bail of the Petitioner stands rejected.
