This matter is taken up through hybrid mode.

This application under Section 482 of Cr.P.C. has been filed by the Petitioners with a prayer to quash the criminal proceeding against the them in connection with I.C.C. No.276 of 2010 (Protest Petition), arising out of C.T. Case No.419 of 2010, corresponding to Jaleswar P.S. Case No.162 of 2010, pending in the Court of J.M.F.C., Jaleswar.

Learned counsel for the Petitioners submits that he has no instruction in the matter from his clients. 4.
Considering the submission of the learned counsel for the Petitioner and the fact that the case is the year 2012, this Court is of the view that the Petitioners are recalcitrant litigants and do not want to proceed with the matter.

Hence, this CRLMC stands dismissed for nonprosecution.

However, if the case is still pending and charge sheet in the aforesaid case has been filed, the Petitioners may seek quashment of the cognizance/charge, if framed, if so advised. 7.
Interim order dated 5th July, 2012 passed by this Court in Misc. Case No.494 of 2012 stands vacated.

Order be communicated to the court concerned forthwith.
