1. Despite the order dated 16th May, 2012 of this Court in the Order No.
present petition, from the report dated 28th July, 2012 of the J.M.F.C., Jaleswar, it appears that the said order of this Court was not produced before the J.M.F.C., Jaleswar for the statement of the Opposite Party No.2 to be recorded under Section 164 Cr.P.C.
2. Nevertheless, since Mr. A.P. Bose, learned counsel for the Petitioner maintains that the Petitioner and Opposite Party No.2 have been married for over 11 years now. It will be open to the parties to appear before the J.M.F.C., Jaleswar and make the appropriate submission in accordance with law. The interim order passed earlier stands vacated.
3. The Superintendent of the concerned Branch is directed to immediately communicate this order to the J.M.F.C., Jaleswar. (Dr. S. Muralidhar) Chief Justice M. Panda
