This application under Section 482 of Cr.P.C. has been filed by the Petitioners with a prayer to quash the F.I.R. in Bhubaneswar Mahila P.S. Case No.152 of 2011, corresponding to G.R. Case No.2525 of 2011, pending in the court of S.D.J.M., Bhubaneswar.

Heard the learned counsel for the parties.

Since F.I.R. allegation discloses a cognizable offence and in the meanwhile charge sheet stated to have been filed against Petitioners No.1 and 2, out of whom, the Petitioner No.1 though in the meanwhile stated to have died, I am not inclined to entertain the prayer made in this petition. 5.
Accordingly, the CRLMC stands dismissed.

However, the Petitioner No.2 against whom the case is stated to be pending, if so aggrieved, may challenge the proceeding by filing a petition in the appropriate forum as appropriate manner.
