This matter is taken up through Hybrid Arrangement (Virtual/Physical Mode).

Heard learned counsel for the Petitioner and the learned Additional Standing Counsel. Perused the records. 3.

This is an application under Section 438 Cr.P.C. filed by the Petitioner for anticipatory bail.

Learned counsel for the Petitioner submits that the Petitioner was working as Additional Tahasildar when the alleged fraud had taken place. It is further submitted by the learned counsel for the Petitioner that all the accused persons except the Petitioner have been served with notice under section 41-A of the Cr.P.C. It is further submitted by the learned counsel for the Petitioner that the Petitioner is a Government servant and now serving as Sub-Registrar, Jatni. 5.

Considering the facts and circumstances of the case, I am inclined to grant anticipatory bail to the Petitioner. However, it is directed that in the event of arrest of the Petitioner by the Arresting

// 2 // Officer in connection with Nayapalli P.S.Case No.603 of 2019 corresponding to C.T.Case No.5681 of 2019 pending in the Court of the learned S.D.J.M., Bhubaneswar, the Petitioner shall be released on bail by the Arresting Officer on such terms and conditions as may deem just and proper.

The ABLAPL is accordingly disposed of.
