This matter is taken up through hybrid mode.

Heard learned counsel for the petitioner and learned counsel for the State.

The petitioner is seeking pre-arrest bail in connection with G.R. Case No.222 of 2022, arising out of K.Bolang P.S. Case No.26 of 2022 pending in the Court of learned S.D.J.M. Bonai for commission of offence punishable under Section 379/34 of IPC. 4.

Taking into account the release of the co-accused by the learned Court in seisin of the matter as stated at the bar, this Court directs that on surrendering within three weeks hence and moving for bail, the petitioner shall be released on bail. The Court in seisin to fix the terms.

It is stated by learned counsel for the petitioners that the petitioner has no criminal proclivity. While enlarging the petitioner on bail the learned Court below shall verify such assertion. If it

comes to the fore that the petitioner has any criminal antecedent, this order shall stands recalled automatically without any further reference to this Court.

Accordingly, the ABLAPL stands disposed of.
