This matter is taken up through hybrid mode.

Heard learned counsel for the petitioner and learned counsel for the State.

The petitioner is seeking pre-arrest bail in connection with G.R. Case No.379 of 2022, arising out of Paikmal P.S. Case No.76 dated 21.04.2022 pending in the Court of learned S.D.J.M., Padampur for commission of offence punishable under Sections 341/294/323/307/506/34 of IPC.

Learned counsel for the petitioner places on record the order dated 28.05.2022 passed in B.A. No.67 of 2022 by the learned Additional Sessions Judge, Padampur relating to the co-accused Debananda Sahu.

On perusal of the same, it is seen that the learned Court below has specifically observed that there is no material on record to attract the ingredients of Section 307 of IPC.

Taking note of such submission and the order of the learned Court below adverted to above, this Court directs that on surrendering, the petitioner shall be released on bail. The learned Court in seisin over the matter to fix the terms and conditions as deemed just and proper. The order passed by the learned Additional Sessions Judge, Padampur be kept on record.

Accordingly, the ABLAPL stands disposed of.
