This matter is taken up through Hybrid Mode.

Heard learned counsel for the petitioners and learned counsel for the State.

The petitioners are seeking pre-arrest bail in connection with G.R. Case No. 12 of 2022, arising out of Kendrapara Sadar P.S. Case No. 67 of 2022 pending in the Court of learned Addl. Dist & Sessions Judge-cum- Special Court, Kendrapara for the alleged commission of offence punishable under Sections341/354-B/323/506/294/34 of the I.P.C. read with Section-18 of the POCSO Act.

Taking into account the statement of the victim, which is annexed to the ABLAPL petition, this Court is not inclined to
entertain the motion at the instance of petitioner no.1-Raju Mallik @ Gautam Mallik. The ABLAPL in respect of Petitioner no.1 stands rejected.

So far as Petitioner Nos. 2 to 5 are concerned, taking into account the nature of allegation against them, this Court directs that on surrendering within three weeks hence and moving for bail, the petitioner nos. 2 to 5 shall be released on bail. The Learned Court in seisin over the matter to fix the terms and conditions as deemed just and proper.

Accordingly, the ABLAPL stands disposed of.
