Heard Mr. P.P. Behera, learned counsel for the petitioner and Mr. A.K. Mishra, learned Additional Government Advocate for the State.

The petitioner has filed this writ petition seeking direction to opposite party no.2 to communicate the status of its application for issue of NOC towards opening of new nursing training institution for B.Sc. Nursing Course pursuant to advertisement no.864 dated 21.07.2020 issued by the Government of Odisha, Health & Family Welfare Department by following the notification dated 22.10.2019 within a stipulated

period.

In course of hearing, Mr. P.P. Behera, learned counsel for the petitioner contended that vide Annexure-3, the petitioner has made representation to the authority indicating the fact that the petitioner has deposited the application fee of Rs.60,000/- and submitted the hard copy at the counter, which has been duly stamped and copy of the same is enclosed, but till date no decision has been taken thereof.

Mr. A.K. Mishra, learned Additional Government Advocate for the State contended that since the matter has come for the first time, he has no instructions. In any case, if the petitioner has any grievance, he may approach the authority by filing fresh representation ventilating the grievances, who shall consider and dispose of the same in accordance with law.

Considering the contentions raised by learned counsel for the parties and after going through the records, it appears that the petitioner has submitted an application before the authority for NOC towards opening of a New Nursing College at Jarada in the district of Keonjhar in the name and style as Vedagarva Institute of Nursing Science vide advertisement no.864 dated 21.07.2020. It is stated that the petitioner has submitted the application on 15.08.2020 and the same

has not been considered nor any communication has been made to the petitioner till date.

In that view of the matter, let the petitioner approach the authority by filing a fresh representation to know about the fate of his application submitted on 15.08.2020. In the event, the petitioner files a fresh representation, the authority shall consider and dispose of the same and communicate the result to the petitioner forthwith.

With the above observation & direction, the writ petition stands disposed of.
