IN THE HIGH COURT OF ORISSA AT CUTTACK
W.P.(C) No. 12045 OF 2022 Bansidhar Patra Petitioner Mr. Trilochan Panigrahi, Advocate -versusState of Odisha and others ....
Opp. Parties Mr. Dillip Kumar Mishra, Additional Government Advocate
CORAM:
JUSTICE K.R. MOHAPATRA
ORDER
Order No.
18.05.2022 01.
1.
This matter is taken up through hybrid mode.
2.
The Petitioner in this writ petition seeks to assail the order dated 7th November, 2014 (Annexure-3) passed by the Tahasildar, Kendrapara in Mutation Case No.4002 of 2014.
3.
It is submitted by Mr. Panigrahi, learned counsel for the Petitioner that the Tahasildar, Kendrapara without following due procedure of law and without complying with the principles of natural justice has passed the impugned order. No notice whatsoever was served on the Petitioner in Mutation Case No.4002 of 2014 for which the Petitioner could not know about the proceeding. He further submits that since the Petitioner has a remedy under the Odisha Survey and Settlement Rules, 1962 to file appeal against the impugned order, interest of justice will be best served if the Petitioner moves the appellate authority. 4.
Since the statutory remedy of appeal is available to the Petitioner, I am not inclined to entertain the writ petition. 5.
Accordingly, this writ petition stands dismissed. 6.
Urgent certified copy of this order be granted on proper application.
