1. None appears for Opposite Party No.2 despite service of notice. Order No.

2. The Petitioner has placed on record a copy of the judgment dated 20th April, 2011 by which the divorce by way of mutual consent under Section 13 (B) of the Hindu Marriage Act, 1955 has been granted by the Judge, Family Court, Khurda in Civil Petition No.167 of 2010.

3. In that view of the matter, the petition is allowed. The order dated 12th August, 2010 passed by the S.D.J.M., Khurda taking cognizance in G.R. Case No.656 of 2009 is hereby set aside.

4. The Superintendent of the concerned Branch is directed to immediately communicate this order to the concerned Subordinate Court.
